Guardianship & Conservatorship

Executing a health care proxy and a durable power of attorney can eliminate the need for a guardianship or conservatorship in many, though not all, cases.

A guardian may be needed to make medical or custodial decisions on a loved one's behalf. A conservator may be needed to help take control of a loved one's finances or create an estate plan. I represent clients with obtaining a guardianship or conservatorship appointment from the probate court, and advise them about their legal responsibilities in connection with their new role. 
   

Conversely, I defend clients in court who are on the respondent or “defendant” side of a guardianship or conservatorship proceeding. In those cases, I advocate for my clients' wishes before the probate court judge.
