Special Needs Planning

Special needs planning is estate planning, with an eye towards planning for the particular needs and concerns of individuals with special needs or disabilities. Many estate planning tools are also suitable for special needs planning, but it’s a somewhat more specialized area because public benefits laws are often involved. Differences include nominating guardians, creating trusts for asset protection, and working with various state agencies to develop the estate plan.
